Business activities

Organization and management of stays for the practice of the following maritime or water adventure sports: surfing, stand up paddle, snorkeling, bodyboarding and bodysurfing, as well as yoga.

The company does not provide travel service to or from the “meeting point”. This is always the responsibility and expense of the client, without any intervention from the company.

However, the company may assist, if requested by the client, in arranging transfer from the airport to the meeting point and/or back. The cost will be directly borne by the client.


Partners

Surfing, bodyboarding and stand up paddle lessons are provided by Brisa Surf School, based at Numancia Street 19, 35010 Las Palmas de Gran Canaria.

Accommodation is usually arranged at «Living Las Canteras» Apartments, “Lago Como” Apartments, “Costa Laraiga” Apartments, “Alisios Canteras” Hotel, “Exe Canteras” Hotel, “Maresía” Hotel, «La Ventana Azul Hostel», as well as in other accommodations available on the website www.airbnb.com.


Contractual regulations

The booking process and the conditions of the contract are subject to these terms under applicable Spanish legislation, especially:

  • RDL 1/2007, of November 16, Consolidated Text of the General Law for the Defense of Consumers and Users (especially Articles 150 and following), and Law 3/2003, of February 12, of the Statute of Consumers and Users of the Canary Islands.

  • Law 34/2002, of July 11, on Information Society Services and Electronic Commerce.


Booking process

1. Contact and information phase

All information regarding activities, stays, and prices is available on the website.

The process always begins with a “contact request” or “booking request” through the online form, including full name, email, arrival and departure dates, and the chosen package. Comments or requests for more information can also be added.

Additional clarifications can be requested by email or phone, and the company will reply by email.
This exchange may be repeated as many times as needed before deciding whether to proceed or not.

2. Booking phase

a) Booking request
The interested party formalizes their request via the online form, or alternatively by phone or email. Phone requests require providing an email address to continue the process, confirming acceptance of these conditions, and acknowledging the Liability Waiver Document.

The client may request optional insurance (health, civil liability, repatriation, and/or cancellation). If not interested, they must declare it expressly. Insurance is provided by Seguros Axa Assistance.

Payment options: bank transfer or PayPal (commissions at client’s expense). Direct credit card payments are not accepted.

b) Provisional booking
If availability exists, the company accepts the provisional booking and notifies the client by email.

  1. Deposit payment
    The client must confirm the booking by paying:

  • 50% of the total price (taxes included), or

  • 100% of the total price (taxes included).

Proof of payment must be emailed to the company.

Provisional bookings last a maximum of 2 hours. Payments made after this period may be refused and refunded immediately.

  1. Acceptance of conditions
    The client will also receive by email:

  • This document “Booking process and general contractual terms and conditions”.

  • The “Informative program of specific booking conditions”.

  • The “Liability Waiver Document(s)”.

The client must reply confirming acceptance.

c) Final booking and payment
Once the deposit is paid and conditions accepted, the booking is final. Confirmation will be sent by email.

If a 10% deposit is chosen, the remaining 90% must be paid upon arrival at the meeting point. Payment is accepted in cash or the same method used for the deposit.

Invoices are issued at the end of the month of the stay.
Failure to pay results in automatic termination of the contract.

Changes requested after confirmation:

  • First change is free if requested more than 3 weeks in advance.

  • Changes within 3 weeks, or subsequent changes, incur a 40 € fee (taxes included).


Liability Waiver Document

Part of these contractual terms, the Liability Waiver Document acknowledges the risks of the activity. It must be signed by hand at the meeting point and delivered to company staff.

Failure to sign and deliver results in automatic termination of the contract.


Minors

Unaccompanied minors are not admitted.
The parent/guardian must sign the Liability Waiver Document(s) with the minor.


Withdrawal and cancellation

The client may cancel at any time, with refund of payments made, but must compensate the company as follows:

  • 40 € (taxes included) for booking management + 50 € (taxes included) for cancellation management.

  • Penalties depending on timing:

    1. 10–15 days before start: 5% of total cost.

    2. 3–10 days before start: 15%.

    3. Within 48h before start: 25%.

Penalties are waived if cancellation is due to proven force majeure (serious illness, weather, strikes, accident, etc).

No-show, non-payment, or failure to sign the Liability Waiver Document results in termination of the contract and full payment due.

SURF LESSON CANCELLATIONS

No refunds or date changes shall be granted in the event of cancellation of surf lessons due to causes beyond the organization’s control, including, by way of example and not limitation, adverse sea conditions, pollution incidents, health risks, or the issuance of coastal phenomenon alerts or warnings by the Cabildo of Gran Canaria or by the competent state authorities. In such cases, the client expressly waives any right to a refund or to reschedule the activity.


Client’s duty of communication

The client must notify the company (and service provider if applicable) of any breach, in writing or in a verifiable manner.


Transfer of booking

The client may transfer their booking free of charge to someone meeting all conditions.

The transfer must be communicated in writing at least 15 days before the start date.

Both transferor and transferee are jointly liable for outstanding payments and justified additional costs.

The transferee must accept the contractual conditions.


Limitation period of actions

Actions derived from the rights recognized to the user under Book IV of Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, expire after two years.


Data protection

The client’s personal data, provided for preparation and contracting, will only be used for this purpose, with the necessary data file being maintained in compliance with the requirements and conditions established by personal data protection regulations. The client may exercise, free of charge and at any time, their rights of access, rectification, cancellation, and opposition.
